Registration of a trade-mark

Canada like many countries, has a federal system for registration of trade-marks which extends to the whole of Canada. The individual provinces in Canada do not have a system for registration of trade-marks. An application in Canada to register a trade-mark may be based upon:

  • proposed use in Canada
  • use or making known in Canada;
  • registration and use abroad;
  • application abroad (which matures to registration) and use abroad.

One advantage of registration of a trade-mark in Canada is that the owner thereby obtains the exclusive right to use the registered trade-mark throughout Canada.
