Trade-marks

"Got an idea?"

You may want to give your product or service a distinctive logo or name for marketing purposes to identify the source of the product or service.

A trade-mark may be eligible for registration with the Canadian Trade-mark Office provided that it is distinctive, not confusingly similar to a trade-mark already used or registered in Canada by somebody else and provided it does not otherwise fall within the categories of unregistrable marks as specified in the Canadian Trade-marks Act. Your lawyer or trade-mark agent is able to co-ordinate searches to help you select a trade-mark that may be available for use and registration in Canada and to register it on your behalf. As with other forms of intellectual property, there are advantages to obtaining a registered trade-mark in Canada, including nation-wide protection. Please see our booklet entitled “You Name it ! An Introduction to Trade-mark Law”.
